Construction Contract Breach

Construction contracts are generally terminated or end in the following ways: (1) the parties perform their obligations; (2) one party fails to perform their obligations without sufficient justification or cause; (3) by mutual agreement of both parties; (4) unforeseen circumstances occurring rendering it impossible to fulfill the contract obligations; or (5) by operation of law, which voids the contract. Take for example. You entered into a construction contract with a roofing contractor to put a new roof on your home for $1,000.00. You pay the contractor half the money when he starts, but he never finishes the job and disappears without justification or cause. Because the roofing contractor failed to complete his obligations under the contract, you have now suffered damages because you had to go out and hire another roofing contractor to finish the job. You are entitled to compensation for your damages as a result of the construction contract breach by the first contractor.
