What can a homeowners association do to us if we fall too far behind on dues? Can they foreclose on us?

Question: Me and my husband are behind on our homeowner’s association fees because he was recently laid off, and we are curious what can they do to us if we fall too far behind on dues? Can they foreclose on us?

Response by Matt Placek: Homeowner’s associations can pretty much regulate anything in a community that the government does not regulate. So they can fine or asses you for money that you owe, and yes in an extreme case they may foreclose on you. If you fear that your husband’s unemployment may take awhile to resolve I suggest that you speak to your homeowner’s association and work something out before the debt gets too large. Also, if you cannot reach an agreement you may want to look into finding an attorney to help your cause. Some attorneys may even take a case pro bono depending on your financial situation.
