The court ordered me to transfer the property under judicial deed to my adult children, can I dispute this?
Question: I have a contract dispute with ownership of a property among myself and my two adult children. In court, under the “judicial deed”, the judge gave the property to my children and I was ordered to leave the house within 30 days. What are my rights?
Response by Pratul Lakhotia: The first matter to consider is the details of the contract dispute which led to the property being conveyed to your children. If you refused to transfer the property under the contract, a judicial deed basically allows the court to convey the property on your behalf. However, if you had considerable reasons in doing so and are within the time allowed, you can ask for reconsideration or file a notice of appeal. This is a fairly complex matter and consulting with a Real Estate Attorney would be highly advisable to help you through this matter.
