How do you go about Setting up a Deed to Transfer Land Ownership?
Question: I am doing some estate planning and I want to ensure that my land transfers to my son when I pass away. Can I do some type of land deed transfer or transfer of land deed to make sure that the land deed transfer goes automatically to my son when I die?
Response: It is possible to arrange or the transfer of land deed to occur automatically upon your death. One easy way to do this involves deed the land to both yourself and your son now, and naming you and your son as joint tenants with rights of survivorship. However, this will be an immediate land deed transfer and the property will be owned by both you and your son as soon as you record the deed in your county clerks office. You can also create a land trust instead of doing a land deed transfer. You should speak with your attorney about what is the best option in your given situation. Your attorney can also help you facilitate the land deed transfer or the creation of the trust.
